Terms of Service

Welcome to Lore, operated by With Lore, Inc. ("Lore," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Lore platform, website, and all related services (collectively, the "Services").

BY USING THE SERVICES, YOU AGREE TO THESE TERMS AND TO OUR PRIVACY POLICY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SERVICES.

1. What Lore Is

Lore is a travel marketplace that connects content creators ("Creators"), travelers ("Travelers"), and tour operators, hotels, and experience providers (collectively, "Operators"). Creators link their existing social media content to bookable travel experiences listed by Operators. When Travelers book through a Creator's link, the Creator earns a commission set by the Operator.

Lore acts as an intermediary platform. We are not the seller, organizer, or provider of any travel experience. We facilitate connections between Creators, Travelers, and Operators and provide the technology for attribution, tracking, and commission management.

2. Registration and Accounts

Creator accounts are currently available by invitation only. Approving, suspending, or terminating any account is at Lore's sole discretion. You must provide accurate, current, and complete information during registration and keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, you must notify us immediately at security@golore.co.

If you create or manage an account on behalf of a company, organization, or other entity, you represent and warrant that you have full authority to bind that entity to these Terms.

3. Age Requirements

You must be at least 18 years old to create a Creator or Operator account. Children under 13 may not use the Services. If we become aware that a child under 13 has provided personal information, we will take commercially reasonable steps to delete it.

Travelers browsing the platform without an account are not subject to age restrictions for viewing publicly available content, but must meet any age requirements imposed by Operators when making a booking.

4. Social Platform Connections

Creators may connect third-party social media accounts (including YouTube, TikTok, and Instagram) to import video content to the platform. By connecting a social account, you represent and warrant that the account belongs to you and that you have read and agreed to that platform's terms of service and privacy policy.

When you connect a social account, Lore requests read-only access to your public video library and basic profile information. We do not post, modify, delete, or take any write action on your behalf on any connected platform.

You may disconnect any social account at any time from your account settings. Disconnecting immediately removes your stored access token from our systems.

5. Creator Content

You retain ownership of all content you create and import to Lore. By importing content or making it available through the Services, you grant Lore a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the platform and in connection with marketing the Services. This license continues for as long as the content remains on the platform and terminates when you remove it or close your account.

You represent and warrant that you own or have all necessary rights to any content you import, and that such content does not infringe the intellectual property, privacy, or publicity rights of any third party.

6. Commissions and Payments

Commission rates are set by Operators on a per-experience basis. Rates are estimates and are subject to change at the Operator's discretion, including due to promotional adjustments, budget changes, or modifications to partnership terms. Lore does not guarantee any minimum earnings.

Operators are solely responsible for paying commissions on bookings generated through Creator links. As a Creator, you will receive commission payments only after Lore has received the corresponding payment from the Operator.

Operators may reverse or deny commissions in certain circumstances, including but not limited to: booking cancellations or refunds by the Traveler, duplicate or fraudulent bookings, bookings tracked through another platform, or experiences explicitly excluded from commission eligibility.

Lore acts solely as an intermediary in the commission process and does not serve as a fiduciary, trustee, or escrow agent. Lore is not responsible for Operator decisions regarding commission approvals, reversals, or non-payment. Lore reserves the right to delay, withhold, or reverse commission payments in cases of suspected fraud, abuse, or violation of these Terms.

Earnings are tracked in your Creator dashboard. Specific payment terms (timing, method, minimum thresholds) will be communicated separately and may be updated as the platform develops.

7. Third-Party Experiences

All travel experiences listed on Lore are provided by independent Operators. Lore is not the provider, organizer, or guarantor of any experience. Any dispute arising from a booking is between the Traveler and the Operator.

While we encourage Operators to maintain accurate and up-to-date listings, Lore does not independently verify every detail of every listing, including pricing, availability, descriptions, photos, or safety information. You acknowledge and accept that listings may contain inaccuracies.

8. Acceptable Use

You agree to use the Services only in accordance with these Terms and all applicable laws. You agree not to:

• Post or link to content that is illegal, deceptive, threatening, abusive, harassing, defamatory, obscene, or otherwise harmful
• Manipulate or attempt to manipulate analytics, click counts, booking attributions, or commission payouts
• Scrape, crawl, reverse-engineer, or otherwise interfere with the platform or its underlying technology
• Impersonate another person, Creator, or Operator
• Violate the terms of service of any connected social platform
• Use the Services to distribute spam, malware, or unsolicited communications
• Register or use any domain name that contains or is confusingly similar to "Lore" or any Lore trademark
• Use any automated means (bots, spiders, scrapers) to access or extract data from the Services without our written consent

We reserve the right to remove any content from the platform at any time and for any reason, at our sole discretion and without prior notice.

9. Disclosure and Regulatory Compliance

As a Creator using Lore, you are solely responsible for complying with all applicable laws, rules, and regulations regarding endorsements, affiliate marketing, and disclosure of material connections. This includes, without limitation, guidance issued by the U.S. Federal Trade Commission (FTC), including the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising and Disclosures 101 for Social Media Influencers.

You must clearly and conspicuously disclose your relationship with Lore and any Operator when promoting travel experiences through your content. Your statements must reflect your honest views and personal experiences. Failure to comply with applicable disclosure requirements may result in enforcement by regulatory authorities and action by Lore, including suspension or termination of your account.

10. Confidentiality

You agree that non-public information you receive through the Services, including commission rates, campaign details, performance data, and Operator terms, constitutes confidential information. You may not disclose, publish, or use such information except as necessary to fulfill your obligations under these Terms. These confidentiality obligations survive termination of your account.

11. Intellectual Property

The Lore platform, including its design, features, functionality, software, text, images, and trademarks, is owned by With Lore, Inc. and is protected by U.S. and international intellectual property laws. All rights not expressly granted in these Terms are reserved.

We may use your name, display name, profile photo, and content thumbnails to promote your profile and linked experiences within the platform, consistent with how you have made that content publicly available.

12. Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate your access to the Services, at our sole discretion, for conduct that we believe violates these Terms, is harmful to other users, or for any other reason, with notice when practical.

Earned but unpaid commissions as of the date of termination will be paid out in accordance with our payment schedule, provided the underlying bookings are not subsequently cancelled or reversed.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LORE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY EXPERIENCE LISTING IS ACCURATE, COMPLETE, OR RELIABLE. LORE DOES NOT ENDORSE OR GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF ANY EXPERIENCE LISTED ON THE PLATFORM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU IN ITS ENTIRETY.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT WILL LORE'S AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT OF COMMISSIONS PAID TO YOU THROUGH THE PLATFORM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

15. Indemnification

You agree to defend, indemnify, and hold harmless With Lore, Inc., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use or misuse of the Services; (ii) your breach of these Terms; (iii) your violation of any applicable law or regulation; (iv) any content you import, post, or distribute through the Services; or (v) your failure to comply with applicable disclosure or regulatory requirements.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the City of New York, and you consent to the personal jurisdiction of such courts.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING UNDER THESE TERMS.

17. Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or through an in-app notice. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.

19. Severability and Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and With Lore, Inc. regarding the Services. If any provision of these Terms is held invalid or unenforceable, that provision will be construed to reflect the original intent as closely as possible, and the remaining provisions will remain in full force and effect.
